By creating an account or using FusionChatalyst (a product of 302CustomDesigns), you agree to these Terms of Service. If you do not agree, do not use the platform.

FusionChatalyst provides an AI-powered chatbot platform that allows businesses to deploy chatbots on their websites for lead capture, customer communication, and appointment scheduling. Features vary by subscription plan.

You must be at least 18 years old and have the authority to bind the business you represent. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

FusionChatalyst offers paid subscription plans. By subscribing, you authorize us to charge the payment method you provide on a recurring basis. Subscription fees are non-refundable except as required by law or as stated in our refund policy.

Free trials are provided as-is. At the end of a trial period, continued use requires selecting a paid plan.

We reserve the right to change pricing with reasonable advance notice. Continued use after a price change constitutes acceptance.

You agree not to use FusionChatalyst to:

• Violate any applicable law or regulation
• Send spam, unsolicited messages, or deceptive communications
• Collect data from visitors without proper disclosure
• Impersonate any person or organization
• Attempt to access the platform's systems without authorization
• Resell or sublicense the platform without written permission

You own the content you add to FusionChatalyst, including your business information, knowledge base, and lead data. By using the platform, you grant us a limited license to process and store that content to deliver the service.

You are responsible for ensuring you have the right to share any content or data you upload, and for complying with applicable privacy laws regarding your visitors' data.

FusionChatalyst integrates with third-party services including Google Calendar, Cal.com, Stripe, and Zapier. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party services.

The FusionChatalyst platform, including its design, code, and content, is owned by 302CustomDesigns. Nothing in these terms transfers ownership of our intellectual property to you.

FusionChatalyst is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or produce any particular business outcome. AI-generated responses may contain inaccuracies and should not be relied upon as professional advice.

To the maximum extent permitted by law, 302CustomDesigns shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost revenue, lost data, or business interruption, even if we have been advised of the possibility of such damages.

Either party may terminate the service relationship at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your access to the platform ends and your data will be deleted within 30 days.

We may update these Terms of Service from time to time. We will notify you of significant changes. Continued use of the platform after changes constitutes acceptance of the updated terms.

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
